1 Scope of application
These terms and conditions are here to inform any client of the conditions in which the seller (referred in this document as «SILLAGES PARIS» or «the seller») proceed to the sale and delivery of the products ordered, and to define the rights and obligations of each party within the framework of the product sales by SILLAGES PARIS to the consumer (in this document «the purchaser», «the client», «the buyer», «the consumer», «the customer» or «the user»).
They apply, without restriction or reservation, to all sales of the products displayed by SILLAGES PARIS on its website (hereinafter the “Site”; or “the Website”). Consequently, the fact that the Buyer has ordered a product sold on the SILLAGES PARIS website entails full acceptance of the present terms and conditions of which the Purchaser acknowledges having taken knowledge prior to his order. The following terms and conditions apply to all the orders placed on our online shop.
SILLAGES PARIS reserves the right to modify at any time these terms and conditions, without notifying the buyer. Nevertheless, the General Conditions of Sale applicable to the order are those accepted by the Purchaser at the time of placing the order.
2 Formation of the contract
The purchase contract is concluded with SILLAGES PARIS SAS.

By placing products in our online shop, we apply those terms and conditions to all the orders placed on our online shop, from the moment when the user clicks on the button “order”. He will receive an order confirmation email afterwards.
A contract binding the two parties (our Website and the User) can therefore be concluded beforehand as follows:
- If you choose to pay by credit card, the contract is made at the time you are debited.
- If you selected PayPal as your payment method, the contract is concluded as soon as your payment has been transferred to PayPal.
3 Information about the site and accessibility of the site
www.sillagesparis.com is an e-commerce merchant owned and managed by SILLAGES PARIS SAS.
The Website is available to all users of the Internet network and is accessible 7 days a week, 24 hours a day, subject to any interruption, planned or not, by SILLAGES PARIS or its providers, for technical maintenance and/or security reasons or cases of circumstances outside of its control, i.e. “force majeure events” as recognized by the French courts. SILLAGES PARIS is not liable for any damage incurred by an unavailability of the Website.
SILLAGES PARIS does not guarantee the availability or accessibility of the Website and does not guarantee that access to the Website, the content on it or the services it provides will be delivered uninterrupted, timely or error-free. For technical maintenance and/or security reasons, SILLAGES PARIS may be obliged to partially or totally suspend access to the Website temporarily and without notice. By accepting these terms and conditions, users accept any such technical interruptions.
SILLAGES PARIS reserves the right to update the Website, particularly for technical or commercial reasons. When any such changes do not alter the conditions of use or, more generally, do not substantially and adversely affect the services that are provided, Users may be informed of the changes made but their acceptance to such changes will not be required.
By registering on the Site, the Client declares and guarantees to SILLAGES PARIS that he is of legal age and has the legal capacity to contract.
SILLAGES PARIS may remove the Client Account at any time, for any reason, at its sole discretion.
4.1 Product Description
The products sold by SILLAGES PARIS are those which appear on the Site, on the day of the consultation of the Site by the Purchaser and within the limit of the available stocks.
SILLAGES PARIS reserves the right to withdraw products from sale at any time.
(1) You may consult the characteristics of the products sold on the SILLAGES PARIS website before ordering.
(2) On the Website, you can buy products customized according to the specificities requested by the user.
(3) On the Website, prices vary according to the country, the mode of delivery and the type of product chosen.
SILLAGES PARIS takes the greatest care in the presentation and description of the products in order to provide the customer with the best possible information. However, some non-substantial errors may appear on the Website, which the customer acknowledges and agrees to.
4.2 E-Gift Card
SILLAGES PARIS sells e-gift cards (gift code) which can be used by the customer or transmitted as a gift to third parties. Thos e-gift cards can't be refunded.
In case of refund of a product purchased with a gift code, the refund is made by sending to the user a new gift code. The gift code or promotional code can be used within 6 months from the date of their issue.
4.3 Availability of products
(1) Products sold are subject to availability. SILLAGES PARIS does not guarantee the availability of the products presented on the site. In case of unavailability of one of the products, the buyer will be informed as early as possible by mail or telephone of the unavailability of the products and the cancellation of his order.
In case of cancellation of the order for unavailability, the order of the buyer will be automatically canceled and his bank account will not be debited. If the product is not available and the customer’s account has already been debited, SILLAGES PARIS will refund the amount to the debited account as soon as possible. SILLAGES PARIS cannot be liable in case of an order cancellation because of stock depletion.
(2) SILLAGES PARIS is entitled to cancel the contract between the Seller and the Buyer from the moment he does not receive the delivery of his order or that the delivery is not possible, in spite of the prior conclusion of the contract Agreement between the two parties.
SILLAGES PARIS is obliged to inform the customer about the unavailability of the service as soon as possible. All sums already paid by the Buyer will be refunded immediately after the cancellation of the order.
(3) In the event of stock shortages, SILLAGES PARIS also reserves the right to establish waiting lists of customers for the delivery of its products. In this case, the buyer is debited to his account at the time of the order without being delivered with his order. As soon as the products are restocked, the order is then sent to the buyer, according to his position on the waiting list. The waiting periods before restocking, indicated to the buyer at the time of the order, are indicative and not contractual. Once the order is made and the buyer is placed on the waiting list, the order cannot be canceled. The order can be refunded after the delivery, according to the terms of return and refund of these conditions.
The prices of the products are indicated in Euros on the SILLAGES PARIS website, or in Pounds for the United Kingdom. When the order is confirmed, the price takes into account the VAT applicable on the day of the order and the delivery costs, if applicable. SILLAGES
PARIS reserves the right to modify the delivery charges at any time prior to the validation of the order by the Purchaser.
The price invoiced to the Buyer will be the price indicated on the final payment and the price indicated on the order confirmation email. The shipping costs will be specified in section 7.2 of the following general conditions of sale.
(1) Each product that the Purchaser wants to add to his order must be added to the cart, by clicking on “Add”. A summary of the total items will be made before proceeding to the payment.
(2) Any order placed on the Website of SILLAGES PARIS requires information from the Purchaser in order to deliver the goods and to make the payment. Once the order has been paid, SILLAGES PARIS sends an email confirming the order to the Buyer. The Buyer is not obliged to create an account, but with this account he will be able to access the data that he has provided on his first order, and to receive gifts and discounts from SILLAGES PARIS.
(3) In order to continue the purchase, the Buyer must inform and verify the billing and delivery address as well as the method of payment. Upon validation of the payment, a confirmation email is sent to the e-mail address provided in advance. It is recommended that the Purchaser retain this document.
(4) SILLAGES PARIS takes the utmost care in presenting and describing its products to best inform and satisfy the Customer. It is possible that the Customer receives, as a result of an Order, a product previously returned by another person. It is specified that SILLAGES PARIS accepts only the return of intact and unused products, our logistic team makes sure this is the case before replacing any returned products in our stocks.
7 Delivery, shipping and transport costs
SILLAGES PARIS delivers its products with Colissimo or Chronopost for orders that include a bottle, or by tracked letters from French post for orders that do not include a bottle.
SILLAGES PARIS delivers its products directly to the Buyer’s home and does not have physical stores.
SILLAGES PARIS supplies its products exclusively to the following countries: France, United Kingdom, Germany, Italy, Spain, Belgium, Netherlands, Luxembourg, Ireland, Austria, Portugal, Switzerland.
The delivery time of the products is 2 to 5 working days depending on the countries and means of deliveries. These times are given as an indication by the carriers and do not commit SILLAGES PARIS. SILLAGES PARIS shall not be liable for any delays in the delivery process of its carriers.
7.2 Sending costs
Shipping costs are indicated before the payment of the order. There is no charge for standard delivery by Colissimo or tracked letter, on all orders. For all orders that include a bottle, the buyer can also choose the express delivery by Chronopost, for an additional fee depending on the country of delivery. This additional fee will be displayed at the stage of the validation of the basket.
In some countries not members of the European Union it is possible that the Buyer is subject to additional customs and shipping costs. SILLAGES PARIS will not be held responsible for the payment of these additional costs and considers that it is the responsibility of the consumer to inquire about the customs duties of the country in which he is located.
7.3 Transport and damage
If the goods are delivered with obvious damage due to transport, the Buyer must notify the delivery company, Colissimo, Chronopost or La Poste without delay and must contact SILLAGES PARIS customer service immediately to allow the latter to deal with complaints as soon as possible. All damage complaints made after the day of delivery might not be taken into account.
7.4 Terms of delivery
The delivery is made to the delivery address indicated by the customer, being specified that it must be the address of the customer’s residence, an individual of their choice or a legal entity (delivery to their company). Deliveries cannot be made either to hotels or P.O. boxes.
Client shall update its personal data, and make sure its delivery data is accurate. If an error occurs relating to the recipient address, SILLAGES PARIS shall not be held liable in case of any inability to deliver the products ordered.
In the event of impossibility of carrying out the Delivery, the carriers mandated by SILLAGES PARIS endeavor to find a safe place to deposit the product. The carriers mandated by SILLAGES PARIS also leave at the address of delivery a notice indicating the place where the Product is located or the procedure to proceed with a new Delivery, if possible. In case of a wrong address or in the absence of withdrawal by the Client, the Customer can contact SILLAGES PARIS or the carrier to organize the re-delivery of his Order in a point of withdrawal. If the order is not withdrawn by the client, the Product is returned to the warehouse of SILLAGES PARIS.
Customer must make sure that they have provided accurate and complete information concerning the delivery address (including in particular: house number number/name, building number/name, staircase, access codes, names and/or numbers for the intercom, etc.).
In case of inability to deliver the products at the address indicated by the customer, products will be returned to SILLAGES PARIS, and no new delivery will be made and the Client will be refunded within a reasonable time as soon as SILLAGES PARIS receives the goods.
Orders are shipped within 14 business days at most for a Delivery in metropolitan France and 20 business days for an International Delivery, from the date after the confirmation of the Order. Nevertheless, the period may be extended up to 10 working days, especially after the launch of a new collection and during December, considering the significant increase of the orders volume.
SILLAGES PARIS cannot be liable for the late Delivery caused by a case of force majeure (as defined below).
If the delivery time is exceeded and is not justified by a case of force majeure, the customer may request the cancellation of the sale and within a maximum period of 15 days will receive a refund of the Order. SILLAGES PARIS cannot be liable of any direct or indirect damage resulting from delay of delivery
8 Conditions of Payment
The Buyer has the following payment options:
Credit card (Blue, Visa, Eurocard, Mastercard)
Your transaction will be made securely in accordance with the 3DS standards.
Your account will be debited as soon as the order process is complete.
You pay the invoice amount online via PayPal. Personal and financial information is sent to the PayPal servers. You must be registered or have a PayPal account to confirm the payment.
Additional information is available during the order transaction.
Gift code and promotional code
It is possible for the Buyer to pay part or all of the amount of his order with a gift code or a promotional code. To do so, the Buyer simply enter the code provided at the time of payment and validate it. The amount of the gift code or the promotional code will then be deducted from the total amount and the Buyer will be able to continue his order.
During the Sillages Exclusifs auctions, the buyer makes his bid by credit card only. The Buyer’s account is debited only if he wins the auction, i.e. if he makes the highest bid at the end of the auction session. Once the amount of the bid has been validated by the buyer in his order, this amount is presumed due to Sillages Paris in the event that no better offer is made.
If the bid is the highest one of the session, its amount is automatically debited from the account of the buyer, at the end of the session. This amount is not refundable. Each bidding session takes place for a limited time, indicated on the site at the time of the auction opening. These auctions are similar to a contract of sale between the buyer and Sillages Paris, and are therefore not controlled by usher.
9 Right of withdrawal, refund and return of goods
9.1 Right of withdrawal
The Buyer has a period of 14 (fourteen) days from the delivery date of his order to exercise his right of withdrawal.
The Buyer exercising his right of withdrawal under the conditions stipulated in the article (9.1.1), will be able to obtain a refund corresponding to the amount of products eligible for returns. If the buyer wishes to exchange his order, he must send back his order to get a refund, and then go back to the site to place a new order.
9.1.1 Terms of return of the goods
(1) Return fees are free of charge, regardless of the country. The buyer must generate the Colissimo return label from the SILLAGES PARIS website, print it and paste it on the return package. The Buyer has a period of 14 days to activate his right of withdrawal from the reception of the order, in appliance with the terms of returns.
(2) The products must imperatively be returned to SILLAGES PARIS in an impeccable state suitable for a new order (products in perfect condition, unused, in their original packaging, with all accessories, notices ...), except in the case of a damaged product due to delivery. Only unused Sillages Paris bottles can be returned and refunded. If a Sillages Paris bottle has been used by the Purchaser to test the perfume (instead of using the sample), then the bottle cannot and will not be refunded. Sillages Exclusifs bottles cannot be returned nor refunded. All sample sets (Sillages Paris and Sillages Exclusifs) cannot be returned nor refunded.
SILLAGES PARIS inspects the goods returned by the buyer to ensure that they comply with these return conditions before proceeding with the refund. If a used bottle or an ineligible product is returned to Sillages Paris by the buyer, this merchandise or used bottle will not be refunded, but they can be returned to the buyer at his expense and his request.

9.2 Trade warranty
The Buyer has a period of 14 days to operate this guarantee from the receipt of the parcel. He must respect the above terms of return and refund.
Misuse of the commercial warranty is prohibited. In addition, it is forbidden for the buyer to make repetitive returns, to get a lot of refunds. The Buyer has the right to make only one return and get one refund per order. Each order can include only one bottle.
9.2.1 100% satisfied or refunded
If the terms of return are respected, the SILLAGES PARIS customer service will proceed to the refund upon receipt of the returned goods and the filled order form (received with the Buyer’s order). This form is to be completed by the buyer at the time of return, and to be attached with his return package. Without this fully filled order form, SILLAGES PARIS does not guarantee the refund will be made. The Customer Service will notify the Buyer by e-mail when the returned good have been received. The customer service will then take the
necessary steps to reimburse the goods within a reasonable time after receipt of the returned goods.

In case of purchase of the order with a gift code, the refund will be made by sending an email
to the buyer with a new gift code of the same amount.
In case of a purchase of the order with a promotional code, the refunded amount will be the amount paid after application of the promotion. The promotional code is only usable once and will not be re-generated or re-usable in case of the refund of an order where it has been used by the Buyer.
10 Retention of title
SILLAGES PARIS retains full ownership of the products sold until full payment of the full price, including principal, fees, taxes and compulsory contributions.
11 Intellectual property
The website of SILLAGES PARIS and all its contents (images, logos, videos, texts ...) is the exclusive property of SILLAGES PARIS. Any total or partial reproduction is prohibited and punishable by law.
12 Obligations of the buyer
Following the purchase of perfumes, SILLAGES PARIS offers the Buyer with the opportunity to publish photos of his perfumes on social media, via a unique link, to win gifts as the buyer gets clicks on this link. In this context, the Buyer is authorized to reproduce and distribute the content provided on the SILLAGES PARIS website. SILLAGES PARIS is not responsible for the buyer’s message attached to the content of SILLAGES PARIS on social media. The buyer nevertheless commits to ensure that the content he posts is in accordance with the law, and that in particular no messages can be considered illegal, discriminatory, racist or violent.
13 Guarantee and responsibility
SILLAGES PARIS’s liability related to the Products is limited to the sale price of each product. SILLAGES PARIS will not be responsible or liable for any following losses, whenever its cause:
- Loss of benefit or sales
- Loss or revenue
- Loss of profits or contract or opportunity
- Loss of expected savings
- Loss of data
- Loss of business, management or administration time
- Damage to the image
- Lost chance and especially of sale or purchase of a product
- Psychological damage
Documents, details, descriptions and information related to the Products published on the Website are not covered under any guarantee, express or implicit, except the guarantees provided by law.
SILLAGES PARIS makes no promises in respect of any harm that may be caused by the transmission of a computer virus, worm, time bomb, Trojan horses, cancelbots, logic bomb or any other form of programming routine designed to damage, destroy or otherwise impair a computer’s functionality or operation including transmission arising from your download of any content, software you use to download the content, the Website or the server that makes it available. In this respect the customer agrees that it is its responsibility to install suitable anti-virus and security software on your computer hardware and other devices to protect against any such bugs, viruses or other such harmful programming routines. Subject to the first paragraph of this section, any content downloaded or otherwise obtained through the use of the Website is done at customer’s own risk and the customer will be solely responsible for any damage to its computer system or loss of data that results from the download of any such content.
SILLAGES PARIS is only required to deliver products which are compliant with the contractual provision. Products are considered as compliant if the following conditions fulfilled: (i) they shall be compliant with the description and have the features mentioned on the Website; (ii) they shall be compliance with the uses which may reasonably be expected of it; (iii) they shall compliant with the quality and strength which may reasonably be expected of similar products.
According to legal regulations, SILLAGES PARIS guarantees the customers against compliance and latent defects, under the following conditions:
In case of visible defect of a Product, the customer shall send a demand to email@example.com within 3 days from the Delivery date. All demands shall mention the defect concerned. Failing that, the demand won’t be accepted and no return or exchange will be possible. The Product shall be returned, with its original packaging, with the original labels, brand new, without having used it, and which the Order reference and copy of such demand shall be sent by mail to the headquarter: SILLAGES PARIS – 53 rue Guy Moquet – 75017 Paris.
Visible defect confirmed by SILLAGES PARIS shall give rise, depending of the demand’s content and the nature of the defect, to exchange or repayment or a voucher.
Non-compliance, latent defects
Subject to the confirmation of a non-compliance or a latent defect by SILLAGES PARIS or the manufacturer, as the case may be, the customer shall enjoy the following guarantees: SILLAGES PARIS, with a registered office located at 53 rue Guy Moquet – 75017 Paris, France, acting as a “guarantor” with the meaning mentioned in articles L217-5 and seq. French Code de la Consommation and articles 1641 and seq. of the
French Code Civil.
The customer may introduce an action resulting from lack of conformity lapses two years after delivery of the Product;
- In the absence of proof to the contrary, any lack of conformity appearing within six
months of delivery of the product is presumed to have existed at the time of delivery;
- In the event of lack of conformity, the buyer shall choose between repair and
replacement of the product, subject to the costs according to Article L217-9 of the
French Code de la Consommation.
The legal guarantee of compliance applies regardless the commercial guarantee described below.
The Customer may also introduce an action based on the latent defect as the meaning of Article 1641 and seq. of the French Code Civil. Such legal guarantee of latent defect allows the Customer to ask for the repayment of a product which is not compliant with the use which may reasonably be expected of it, within 2 years from the discovery of the
The Customer has the choice between two options: keep the Product and ask for a price discount or return the Product and ask for the complete repayment of the price paid, according to the Article 1644 of the French Code Civil.
Pursuant to order 2005-136 of February 17, 2005, of the French Consumer Code / French Civil Code, the whole of the applicable texts are reproduced here:
Art. L. 217-4 of the French Consumer Code: “The seller is obliged to deliver a product conformant to the contract and to respond to defects of conformity which exist at the time of issuance. They must also respond to conformity defects resulting from the packaging, instructions for assembly or installation when these have been made their responsibility by the contract or have been produced under their responsibility.”
Art. L. 217-5. of the Consumer Code: “To comply with the contract, the product must: 1) Be appropriate for the use normally expected for such a product and, where appropriate: a) correspond to the description given by the seller and have the qualities presented to the customer in the form of a sample or model; b) have the qualities that a customer might legitimately expect in view of public statements made by the seller, the manufacturer or their representative, particular in terms of advertising or labelling. 2) Or present the characteristics defined by mutual agreement by the parties or be appropriate for any special use sought by the customer that has been brought to the notice of the seller and which the latter has accepted.”
Art. L. 217-12 of the Consumer Code: “Action resulting from a lack of conformity is barred by limitation for two years from the delivery of the goods.”
Art. 1641 of the Civil Code: “A seller is bound to a warranty on account of the latent defects of the product sold which render it unfit for the use for which it was intended, or which so impair that use that the customer would not have purchased it, or would only have offered a lower price for it, had they known of them.”
Art. 1648, paragraph 1 of the Civil Code: “The action resulting from critical flaws must be brought by the buyer within a period of two years following the discovery of the critical flaw.”
Upon the occurrence of an event of force majeure, the concerned party shall inform the other within a period of fifteen (15) days of the occurrence of this event, by email or registered letter with acknowledgement of receipt. Specifically considered as cases of force majeure or fortuitous event, in addition to those regularly cited by the jurisprudence of the French courts and tribunals, are total or partial strikes, lockouts, riots, boycotts or other actions of an industrial nature or commercial disputes, civil unrest, insurrection, war, terrorism, bad weather, epidemics, blocking of the means of transport or supply for any reason whatsoever, earthquake, fire, storm, flood, water damage, governmental or statutory restrictions, legal or regulatory modifications of marketing changes, computer failure, blocking of telecommunications, including wired or wireless telecommunications networks, and any other instance independent of the will of the parties preventing the normal execution of the contractual relationship.
All the obligations of the parties will be suspended for the duration of the event of force majeure, without compensation. If the event of force majeure continues for more than three
(3) months, the contract may be terminated without compensation for one or other of the parties.

15 Partial Invalidity
If any provisions of these T&C’s are held to be invalid or declared such under any law, regulation or following a final decision of a competent jurisdiction, such provision shall nonetheless be enforced to the fullest extent permitted and the other provisions shall remain in full force and scope.
16 No waiver
No tolerance, inaction or inertia of SILLAGES PARIS shall be interpreted as a waiver of its rights under those terms & conditions.
17 Applicable law and jurisdiction
These General T&Cs are governed by the laws of France.
In the event of a dispute between the Client and SILLAGES PARIS concerning the interpretation, performance or termination of this T&C’s, SILLAGES PARIS strongly encourages the Client to contact the company in the first instance to attempt to resolve the disagreement amicably. SILLAGES PARIS hereby notifies Clients that there are alternative dispute settlement options such as mediation or arbitration.
If no amicable solution to the dispute is found, SILLAGES PARIS and the Client agree to refer the dispute to the French courts. The terms of this article do not deprive consumers of their right to take legal action, or to defense in the event of legal action, in their country of residence or domicile, or of their right to consumer protection measures as set out in the legislation applicable in their country of residence.
Sillages Paris recognizes the importance of protecting the privacy of all consumers ("you" or "user") who visit the SILLAGES PARIS hosted or sponsored websites.
Personal information collected over the Sites may be transferred to other countries for the purposes described below. The laws of France shall apply to the collection of Personal Information (as defined below) through the Sites. The laws of France and other countries to which we may transfer your personal information may not provide a level of protection equivalent to the laws in your home country.
Collection and use of information
a. Personal Information
While users can view our website by browsing anonymously, we collect identifiable personal information ("Personal Information") about Sites users when they voluntarily register or otherwise sign up with the Sites, contact us via the Sites, or voluntarily provide it to make purchases from the Sites, as applicable. Sites users may provide Personal Information for various reasons, including but not limited to, for the purposes of obtaining newsletters, product information, event information, and services, to answer surveys, enter contests and receive notice of other promotional opportunities, and to make purchases, as applicable. The type of Personal Information that we may collect includes name, address, phone number, gender, birthdate, email address and purchase information such as credit or debit card information used to facilitate the sale of Sillages Paris products, as applicable. We may also use the information that you provide to establish global market trends, or to create a personal customer profile in order to let you know of products or events that may be of interest to you and to streamline future purchases, as applicable. We may combine Personal Information we collect on the Sites with other information we collect offline about users to better tailor marketing or website content or for other purposes, such as internal research. b. Non-Personal Information
We collect certain aggregate and non-personal information when you visit the Sites. This information does not relate to a single identifiable visitor. It tells us such things as how many users visited the Sites and the pages accessed, or the number of clicks you get on the material you share. Collecting this information helps us tailor our Sites to our visitors.
When you visit the Sites to browse, read or download information, we automatically collect standard computer information that your browser sends to every website you visit, such as your IP address, browser type and language, access times and referring website addresses. We generally do not link standard computer information to anything that will allow us to identify users unless to enforce compliance with our rules or terms of service or to protect our service, sites, users or others.
We also may collect aggregate and non-personal information through "cookies" or "web beacons", as explained below.
Cookies are pieces of information that any website may transfer to your browser that are then stored in your computer system. Cookies are returned to the website that deposited them when a visitor returns to that site.
